Zakon.kz: Rules for issuing online microloans have been complicated in Kazakhstan

By the resolution of the Board of the Agency of the Republic of Kazakhstan for the Regulation and Development of the Financial Market dated April 30, 2021, amendments were made to the Rules for the provision of microcredits by electronic means, zakon.kz reports.

Now, to receive an online loan during registration, you must enter the following data in your personal account:

-surname, name, patronymic (if any) indicated in the identity document;
-individual identification number;
-number and validity of the identity document;
-subscriber number of a cellular device;
-bank account details (IBAN) and / or details of the client's payment card (except for the provision of microcredits through terminals);
-a full-face photograph of the client against a light background, with a neutral facial expression and a closed mouth.
At the same time, for registration in a personal account, a client - a legal entity enters the following documents in a scanned form:

an order on the appointment of the head of the executive body of a legal entity or a power of attorney confirming the powers of the person authorized to sign the microcredit agreement;
surname, name, patronymic specified in the identity document of the person authorized to sign the microcredit agreement;
bank identification number of the client - legal entity;
individual identification number of the person authorized to sign the microcredit agreement;
number and validity of the identity document of the person authorized to sign the microcredit agreement;
certificate of state registration / re-registration of a client-legal entity;
subscriber number of the mobile device of the client - legal entity;
bank account details (IBAN) and / or payment card details of a client - a legal entity;
a full-face photograph of a client against a light background, with a neutral expression on his face and a closed mouth, authorized to sign a microcredit agreement.
At the same time, the microfinance organization, in order to confirm the registration of the client, verifies the data provided by:

- by a client - an individual: last name, first name, patronymic, individual identification number and a photograph of the client;

- by a client - a legal entity: last name, first name, patronymic and photograph of the person indicated in the identity document of the person authorized to sign the microcredit agreement.

Registration of a client in a personal account is carried out in one of the ways indicated above.



After registering the client in the personal account, the subsequent admission of the client to the personal account is carried out by generating and entering passwords or using at least one of the authentication features (tokens, smart cards, one-time passwords).


When changing a mobile phone or its number, changes are made about the client's cellular communication device and bank account details (except for the provision of microcredits through terminals) in the personal account.



At the same time, the data on the individual identification number / business identification number of the client cannot be changed in the personal account.


As noted, the following methods are used to identify and authenticate a client in the client's personal account:

electronic digital signature submitted by the national certification center of the Republic of Kazakhstan;
biometric identification through the use of data center services;
two-factor authentication.
Two-factor authentication is performed using the following two parameters:

generating and entering passwords or using at least one of the authentication features (tokens, smart cards, one-time passwords);
using software that meets the following requirements:
- providing verification and confirmation of the client's image in real time with his image on the identity document
- ensuring the security of the client's personal data when exchanging and storing information;
- protection against the use of a printed paper image of the client's face;
- protection against the possibility of duplicating video or photo playback from another peripheral device.


It is also said that the conclusion of an agreement on the provision of microcredit, amendments and additions to the agreement on the provision of online microcredit between the microfinance organization and the client is carried out by means of an EDS or by generating and entering passwords or using at least one of the authentication features (tokens, smart cards , one-time passwords).


Microcredit is provided electronically by transferring money from the organization's bank account to the client's bank account (payment card), as well as by issuing cash to the client through a terminal or cash desk.



In case of detection of unauthorized access to information constituting the secret of providing microcredit, its unauthorized change, unauthorized actions by third parties, the MFI must take measures to eliminate the causes and consequences of such actions within two working days, and within one working day informs about this the client and the authorized body, - the document says.


The regulation comes into force on May 17, 2021.
